Terms of Use.

The rules that govern your use of this website, governed by the laws of the State of California.

1. Agreement.

These Terms of Use ("Terms") are a binding agreement between you ("you," "user") and the owner of the Pink.TV domain ("Operator," "we," "us"). By accessing or using pink.tv (the "Site"), submitting the offer form, or contacting us by email about the domain, you accept these Terms. If you do not accept them, do not use the Site.

2. Nature of the Site.

The Site is an informational presentation describing the Pink.TV domain name, the market context for premium .TV domains, and the process by which offers to acquire the domain are reviewed. The Site is not a marketplace listing, an auction, an offer to sell on specific terms, or a solicitation of any specific price.

3. Submissions are not binding contracts.

If you submit an offer through the form on this Site or by email, your submission constitutes an unsolicited offer to purchase the Pink.TV domain on the terms you describe. The Operator is under no obligation to accept, counter, acknowledge, or respond to any submission. No contract for sale is formed unless and until both parties execute a written purchase agreement and that agreement is performed (typically through licensed third-party escrow). Any verbal or informal correspondence is non-binding until a written agreement is signed.

4. Informational content; no professional advice.

The articles in the Pink.TV Journal and elsewhere on this Site discuss domain-name market data, regulatory mechanics, and transaction processes. This content is provided for general informational purposes only. It does not constitute legal, financial, tax, investment, or trademark advice. Domain-name acquisitions can involve material legal and trademark exposure depending on the buyer's intended field of use; you should consult your own qualified counsel for advice specific to your circumstances.

5. Comparable sales and market data.

References to other domain sales prices, ad-spend forecasts, viewership statistics, and industry benchmarks are drawn from publicly reported sources cited inline. Public sales data is incomplete; private transactions are typically larger and unreported. Comparables are reference points only and do not constitute appraisals, opinions of value, or guarantees of similar pricing for any current or future transaction.

6. No warranty.

The Site, the offer form, and all content on it are provided "as is" and "as available," without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability. We do not warrant that the Site will be free of errors, viruses, or other harmful components, or that defects will be corrected.

7. Trademark; freedom to operate.

The word "pink" is the subject of many existing trademark registrations across many classes worldwide. The Operator makes no representation as to whether any prospective buyer is free to use "Pink.TV" — or any business name based on it — in the buyer's intended field of use. Trademark clearance is the buyer's responsibility, to be conducted with qualified trademark counsel.

8. Limitation of liability.

To the maximum extent permitted by law, the Operator and its affiliates, officers, agents, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, or lost business opportunities, arising out of or related to your use of the Site, your reliance on any information on the Site, or any submission you make through the Site, regardless of legal theory and whether or not we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, our aggregate liability is limited to the greater of (a) one hundred U.S. dollars (US$100), and (b) any amount you have paid us in the preceding twelve (12) months in connection with a transaction.

9. Acceptable use.

You agree not to: (a) use the Site or the offer form to send unlawful, fraudulent, deceptive, harassing, or abusive content; (b) attempt to interfere with the operation of the Site, including via scraping, denial-of-service, or unauthorized access attempts; (c) use any automated system to submit form entries; (d) submit offers in bad faith, including offers from spoofed identities or with no intent or capacity to close.

10. Intellectual property.

All content on this Site — including text, design, code, layout, and the Pink.TV name and mark to the extent of any rights therein — is owned by the Operator or used with permission. You may not reproduce, redistribute, or create derivative works of the Site's content for commercial use without prior written consent. Citations and short quotations for review or reporting purposes are permitted under applicable fair-use principles.

11. Third-party services and links.

The Site may link to or rely on third-party services (including Web3Forms for form handling, Cloudflare for delivery, Google Fonts for typography, and various sources cited in the Journal). The Operator does not control those services and is not responsible for their content or availability. Your use of those services is governed by their own terms and policies.

12. Indemnification.

You agree to indemnify and hold harmless the Operator and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any applicable law, or (c) your use of the Site in any manner that gives rise to a claim by a third party.

13. Changes to these Terms.

We may revise these Terms at any time by updating this page. The "Last updated" date at the top of the page reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.

14. Governing law and venue.

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or the Site is the state and federal courts located in the State of California, and you consent to the personal jurisdiction of those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

15. Severability and entire agreement.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Site, and supersede any prior or contemporaneous agreements on that subject.
